Terms & Conditions of Hire
DEFINITIONS:
“The Company” means Brookes Party Hire, ABN 89 412 075 439, its employees, subcontractors, and agents.
“The Hirer” means the person(s), company or entity hiring goods and/or services from The Company.
“Equipment” or “Goods” means all items supplied by The Company, including but not limited to furniture, décor, signage, balloons, props, structures, inflatables, electrical goods, soft play, linens, tableware, or vehicles.
“Site” or “Venue” means the physical location where Equipment is delivered,
installed, used, or collected.
“Hire Period” means the duration from delivery to collection as agreed between The Company and The Hirer.
“Force Majeure” means any circumstance beyond The Company’s reasonable control, including but not limited to acts of God, natural disasters, severe weather, war, terrorism, strikes, pandemics, government restrictions, or failure of suppliers.
1: BOOKINGS, PAYMENTS & PRICING
All bookings require a non-refundable deposit of 10% of the total hire cost to confirm the reservation.
- The final balance payment is due 14 days prior to the event date. Once paid, it becomes final and non-refundable.
- Accepted payment methods: credit card, bank transfer.
- The Company reserves the right to cancel any booking not paid in full by the due date.
- All prices are exclusive of GST unless stated otherwise.
- Quotations are valid for 14 days from the date of issue unless otherwise stated.
- Minimum hire amounts may apply, especially for delivery outside standard zones.
- Discounts, promotions, and package pricing may not be combined unless expressly stated.
2: CHANGES TO ORDERS
- Changes to orders must be made in writing and may be subject to availability.
- Reductions in quantities or items within 14 days of the event date may be treated as cancellations and non-refundable.
- Substitutions of similar items may be made by The Company if products are unavailable due to damage, prior hire delays, or supplier issues.
3: CANCELLATIONS & REFUNDS
- Cancellations over 14 days prior to the event date may receive a refund of monies paid minus the non-refundable deposit.
- Cancellations within 14 days of the event date forfeit all payments made.
- No refunds will be issued for:
- Change of mind
- Poor weather where no suitable indoor option is available
- Venue restrictions outside The Company’s control
- Customer’s inability to accept delivery
- Refunds, if applicable, are processed within 14 business days.
- Credit notes may be offered at The Company’s discretion.
4: DELIVERY & COLLECTION
- Standard delivery and collection hours are 7:00am to 10:00pm. Deliveries outside these hours may incur additional charges.
- Delivery does not include unpacking or placement unless otherwise arranged.
- The Hirer must:
- Ensure someone is available to accept delivery.
- Provide accurate delivery details and instructions.
- Ensure the venue is accessible, safe, and compliant with local regulations.
- Additional fees may apply for:
- Difficult or restricted access (e.g. stairs, elevators, uneven terrain).
- Delivery or collection delays beyond reasonable waiting times (e.g. more than 30 minutes).
- If delivery or installation is impossible due to incorrect information provided, The Company may:
- Reschedule for an additional fee.
- Cancel the order without refund.
5: INSTALLATION & SITE CONDITIONS
- The Hirer must ensure:
- The Site is level, firm, free of debris, and accessible for vehicles and staff.
- Sufficient overhead clearance exists for installations (e.g. marquees, backdrops).
- No underground cables, pipes, or services exist where stakes, pegs, or weighted structures will be installed.
- The Company reserves the right to refuse installation if conditions are unsafe or unsuitable.
- Power supply, water access, and lighting (where required) are The Hirer’s responsibility.
- While The Company takes all reasonable care during installation and removal, The Hirer acknowledges that some minor surface damage to turf, flooring, or surfaces may occur due to normal wear and tear from the hire equipment. The Company carries $5 million public liability insurance covering damages directly caused by our staff’s negligent actions.
- The Company will not be liable for pre-existing site conditions or damage resulting from unsuitable surfaces or incorrect Hirer instructions.
6: WET WEATHER & WEATHER RISK
- The Hirer is responsible for arranging a suitable alternative installation location (e.g. undercover or indoor) in the event of bad weather.
- The Company may refuse outdoor installations in: High winds, Heavy rain, Lightning, Any hazardous conditions.
- Where feasible, The Company will work with The Hirer to reschedule the event to a later date, provided non-consumable goods have not already been allocated or customized for the original job (e.g. balloon garlands already inflated).
- No refunds are given solely due to wet weather if an alternative location or reschedule is not possible.
7: HIRE PERIOD & EXTENSIONS
- The standard hire period is 24 hours unless otherwise agreed.
- Extended hire is available for additional fees.
- Equipment not ready for collection on the agreed date may incur:
- Additional hire charges.
- Replacement costs if subsequent bookings are affected.
8: CLEANING & RETURN CONDITIONS
- Equipment must be returned in the same condition as delivered.
- Fees apply for cleaning:
- Excess food residue, Wax Spills, Mud, Grass, sand, or dirt.
- Confetti, glitter, or balloon fragments.
- Tableware and linens must be free of food debris and returned in supplied bags or crates.
- Missing or damaged crates, bags, or protective covers are chargeable.
9: DAMAGE, LOSS & LIABILITY
- The Hirer accepts full responsibility for the Equipment during the hire period.
- Any damage, theft, or loss is chargeable at current replacement cost plus shipping.
- The Hirer is liable for: Scratches, dents, chips, rips, burns, stains
- Water or moisture damage
- Damage due to misuse, neglect, or improper storage
- The Company will inspect returned goods and issue invoices for damage or missing items.
- Damage waiver fees (if paid) do not cover:
- Malicious damage
- Theft or loss
- Misuse or neglect
- The Hirer agrees to pay all costs associated with repairs or replacement.
- The Company’s liability is limited strictly to: Replacement of defective goods; or Refund of hire fees paid for unusable goods.
- The Company is not liable for:
- Indirect or consequential losses
- Business interruption
- Loss of profits
- Venue restrictions preventing use
- The Hirer is responsible for any permits, licenses, or specific event insurance (including weather cover) required for their event. The Company’s insurance covers only our works on-site and our direct equipment liability.
10: EQUIPMENT USE & SAFETY
- Equipment is for intended event-use only.
- The Hirer must not:
- Sub-hire equipment.
- Modify items.
- Use items for hazardous or unlawful activities.
- Electrical items require:
- Certified power supply.
- Use of RCDs or safety switches.
- Inflatables and soft play require adult supervision at all times.
- Weight limits, safety instructions, and signage must be followed.
11: EVENT DÉCOR DISCLAIMERS
- The Hirer acknowledges that:
- Helium balloons may deflate or expand in extreme heat or cold and should not be stored in direct sunlight or vehicles.
- Balloon finishes such as gloss sprays may alter colour or finish and can transfer residue to hands or fabrics.
- Latex balloons can oxidize and become matte over time.
- The Company does not guarantee longevity of décor elements once delivered or installed due to varying environmental conditions outside our control.
12: PHOTOGRAPHY & SOCIAL MEDIA
- The Company reserves the right to photograph installations for promotional purposes unless The Hirer requests otherwise in writing.
- The Hirer grants permission for Brookes Party Hire to share event photos on social media and marketing materials unless explicitly declined.
- The Company encourages social media sharing and appreciates being tagged:

- Facebook [facebook.com/brookespartyhire]
- All images, logos, and designs remain the intellectual property of Brookes Party Hire.
13: INTELLECTUAL PROPERTY
- All logos, designs, product images, and content remain the property of Brookes Party Hire.
- Copying, reproducing, or replicating designs or photographs without permission is prohibited.
14: FORCE MAJEURE
The Company shall not be liable for failure to perform obligations where prevented due to Force Majeure, including but not limited to:
- Acts of God
- Fire, flood, cyclone, storm
- Government restrictions or lockdowns
- Strikes, lockouts, industrial action
- Equipment breakdown beyond control
15: JURISDICTION
These Terms & Conditions are governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of Queensland.
ACCEPTANCE
By confirming a booking or accepting delivery of goods, The Hirer acknowledges they have read, understood, and agree to these Terms & Conditions.
